Terms and conditions for serving the transfers being offered by TAXI2.EU.


These Terms and Conditions (hereafter: 'Conditions') apply to all offers from, and agreements with TAXI2.EU and does not exclude additional conditions TAXI2.EU can apply. By registering on our website, you accept the TAXI2.EU Conditions in full. The in this Conditions specified content, can only be waved after written approval of TAXI2.EU, in which case the remaining provisions shall remain applicable in full force.

All rights and claims, as in these Conditions and any further agreements for TAXI2.EU are stipulated, are also stipulated for TAXI2.EU intermediaries and other third parties. These conditions respect the rights of the consumer arising from the law (or agreement).


Offers/ agreements:

TAXI2.EU is entitled to refuse a registration or request certain conditions to a registration. TAXI2.EU has no responsibility for the contracts being concluded between the taxi ride requester (hereinafter 'the passenger’), and the registered driver.
 

Prices and payments:

TAXI2.EU prices on the TAXI2.EU website are equal to or lower than the rates that partners charge for equal work / transports. There are two payment options for the passenger when booking a trip:

  1. A deposit is made by the passenger that equals the amount of commission. The remainder is paid to the driver. TAXI2.EU provides an invoice, each month on the fifth day, that states the executed transports in the previous month that were paid with a deposit as "paid".
  2. The passenger pays full fare price in advance.  Each week, on Tuesday, credit notes are provided by TAXI2.EU to the partner. The credit note includes all full fare paid services of the previous week. The credit note is equal to the amount paid by the passenger, after deducting our commission this amount is transferred / paid to the partner.

Partner is responsible to provide all requested data to enable TAXI2.EU to make payments. Partner is responsible to maintain account with their up to date details. TAXI2.EU is not responsible for any bank/payment fees occuring after providing inaccurate (bank) details.

Non-SEPA payments: will be paid on a monthly base, by Paypal. Partner is able to postpone payment (to next month) to reduce payment costs.


Service fee:

In consideration of Company’s provision of the TAXI2.EU Services for your use and benefit hereunder, you agree to pay Company a service fee (commission) on a per Transportation Services transaction basis calculated as a percentage of the Fare determined by the Fare Calculation (regardless of any Negotiated Fare), as provided to you via email or otherwise made available electronically by Company from time to time for the applicable Territory (“Service Fee”). Company reserves the right to change the Service Fee at any time in Company’s discretion based upon local market factors, and Company will provide you with notice in the event of such change. Continued use of the TAXI2.EU Services after any such change in the Service Fee calculation shall constitute your consent to such change.


Receipts

As part of the TAXI2.EU Services, Company provides you a system for the delivery of receipts to Users for Transportation Services rendered. Partner is responsible to update the data of any local applicable taxes in their account. Upon your completion of Transportation Services for a User, Company prepares an applicable receipt and issues such receipt to the User via email on your behalf. Such receipts are also provided to you via email or the online portal available to you through the TAXI2.EU Services. Receipts include the breakdown of amounts charged to the User for Transportation Services and may include specific information about you, including your name, contact information and photo. Any corrections to a TAXI2.EU receipt for Transportation Services must be submitted to Company in writing within three (3) business days after the completion of such Transportation Services. Absent such a notice, Company shall not be liable for any mistakes in or corrections to the receipt or for recalculation or disbursement of the Fare.


Taxes

All payments of TAXI2.EU are excluding VAT and other possible applicable taxes. All applicable taxes are payable by the Partner. The Partner is responsible to provide TAXI2.EU with a valid VAT number to enable correct billing.


Complaints and liability:

If demonstrated that the registered partner and/or passenger does not meet the agreement, TAXI2.EU is not liable for any damage incurred by the partner and/or passenger.

The partner is obliged to comply with its agreement with the passenger.

In case of gross negligence or the discredit of TAXI2.EU, TAXI2.EU has the right to remove the partner profile and to recover all possible costs, for example: costs of possible damage.

 

Transport assignments/ communication:

TAXI2.EU is not liable for misunderstandings, delays, improper transportation details , the content of profiles of partners and incorrect announcements, that occur due to the use of internet or other communication channels between a partner and TAXI2.EU and/or TAXI2.EU intermediaries and other third parties.
 

Personal data:

TAXI2.EU stores the provided / needed personal data of a partner in a central database.

The necessary data (the profile) is provided to a passenger after booking a transport.

The processing of your data is always done according the applicable laws and regulations.


Partner account

Partner is responsible to provide all data required and keep all data in their account up to date.

 

Calamity / disaster:

In case of a calamity / disaster TAXI2.EU is not obliged to compensate any costs, unless due to the circumstances this is considered to be unacceptable according to standards of reasonability and equitability.

Calamity / disaster is defined as any failure that TAXI2.EU cannot be inculpated for, not under the law, legal act.


Transfer Service Requirements

For transfers from the airport (airport pick-ups) the standard waiting time included in the fare price is 1.5 hour (one hour and thirty minutes), calculated from planned landingstime. In case of a (flight) delay > 1 hour of the Customer, the Driver holds the right to charge for the additional waiting time (the total time driver has to wait minus 1 (one) hour).

Upon departure, our Partners will wait by the pick-up point a maximum of 20 minutes after the published pick-up time. After 20 minutes, a waiting fee might be charged directly by the Partner.

Meet&Greet requests: always wait at the gate for the client with a sign stating client's name. If this might not be possible due to local regulations, wait as close as possible to the arrival gate for the client (or at the local Meet&Greet airport area) holding a sign with the name of the client.

The Partner is obligated to call the Customer as soon as possible when he cannot find the Customer in order to facilitate the physical meeting between Partner and Customer.

Partner is responsible for monitoring the flight of the Customer, based on flight number provided by the Customer.
 

Supplementary provisions

The by TAXI2.EU shown profiles and images may deflect from reality.

In case TAXI2.EU for any length of time does not strictly administer the Conditions to a partner, the right remains in full for TAXI2.EU to demand immediate and strict compliance with these conditions. In case one or more provisions of these Conditions or any other agreement with TAXI2.EU is in conflict with any applicable provision, the provision will be reviewed and replaced by TAXI2.EU.

 

Governing Law and Jurisdiction:

The Dutch law applies to all rights, obligations, offers and agreements to which these Conditions apply, as well as these conditions. All disputes between parties will be exclusively submitted to TAXI2.EU by specified jurisdiction for that purpose in the Netherlands.
